1. Agreement and operator
AdPole is operated by Fermats Retail Private Limited (“AdPole”, “we”, “us” or “our”). By creating an account, installing or pairing the extension, or otherwise using the service, you agree to these Terms of Use and the Privacy Policy.
If you use AdPole for an organization, you confirm that you are authorized to accept these terms for that organization. If you do not agree, do not use the service.
2. Account eligibility and responsibility
You must be legally capable of entering into these terms and provide accurate account information. You are responsible for safeguarding your password, controlling access to your account and Chrome profiles, and promptly reporting suspected unauthorized use.
Workspace administrators manage membership and may invite, remove or change the role of members in their workspace. Do not share extension credentials or attempt to use a connection issued to another person or workspace.
3. The AdPole service
AdPole helps users deliberately save advertising and creative references, preserve available source information and media, organize references into workspaces, Boards, Folders and Tags, add Notes, and search and retrieve those references later.
Source sites and browser behavior can change. Some media cannot be copied from its source; AdPole may therefore store a preview, user-initiated frame, source link or metadata rather than a complete media file. We do not guarantee permanent availability of third-party source content or links.
4. User-provided and saved content
You retain any rights you have in content you upload and the organization information you create. You grant us the limited permission needed to host, process, reproduce and display that content to provide and secure AdPole for your workspace.
You are responsible for deciding what to save and for having the rights or other lawful basis needed to save, upload, use and share the content within your workspace. Content that is visible in a public browser page is not automatically free of copyright, trademark, privacy or contractual restrictions.
AdPole does not endorse or take responsibility for third-party advertising content, claims, destinations or source-site practices.
5. Acceptable use
You must not use AdPole to:
- violate law, another person's rights or a source site's applicable terms;
- collect, request, transmit or harvest passwords, cookies or session tokens;
- bypass a CAPTCHA, access control, paywall, rate limit, anti-bot control or technical restriction;
- run unsupported automated or large-scale scraping, crawling or monitoring;
- access private source-platform content without authorization;
- probe, disrupt, overload or compromise AdPole or another service;
- introduce malware, malicious code or content intended to harm others;
- use another person's account or workspace without permission; or
- resell or sublicense the service unless we have agreed in writing.
AdPole's V1 extension is a user-initiated capture tool. Its source-specific Save controls are not permission to automate activity outside the product's supported workflow.
6. AdPole intellectual property
AdPole, its software, branding, interface, documentation and other service materials are owned by us or our licensors and are protected by applicable intellectual-property laws. These terms give you a limited, revocable, non-exclusive right to use the service as provided; they do not transfer ownership of AdPole or third-party content.
Feedback may be used to improve AdPole without restriction or payment, provided we do not identify you publicly as the source without permission.
7. Service availability
We may maintain, update, change or discontinue parts of AdPole. We aim to provide a reliable service but do not promise uninterrupted access, error-free capture, compatibility with every browser configuration, or continued support for a third-party source that changes or blocks the relevant workflow.
8. Suspension and termination
You may stop using AdPole at any time and can revoke connected browser profiles in Settings. You may request account or data deletion through Support.
We may restrict, suspend or terminate access when reasonably necessary to address a violation of these terms, security risk, unlawful activity, non-payment under a future paid plan, harm to the service or other users, or a legal requirement. Where practical, we will provide notice and an opportunity to resolve the issue.
9. Disclaimers
To the extent permitted by applicable law, AdPole is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.
AdPole is a research and organization tool. It does not provide legal advice, rights clearance, advertising-platform approval, performance predictions or a guarantee that saved content may be reused.
10. Limitation of liability
To the extent permitted by applicable law, Fermats Retail Private Limited and its personnel will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunity arising from the service.
Nothing in these terms excludes liability that cannot lawfully be excluded. Any further limit applicable to a paid plan may be stated in the order or plan terms presented for that plan.
11. Changes to these terms
We may update these terms as AdPole develops. We will revise the effective date and provide additional notice when a change is material and the circumstances require it. Continuing to use AdPole after updated terms take effect means you accept the updated terms.
12. Support and contact
Questions about these terms or the service can be sent to sales@roimagnet.com or through the AdPole Support page.
